-Our agency does not provide a for sale board, even upon request.
-Our agency is choosing to only operate in England at this time and reserve full rights to deny any requests to market any property that we do not wish to market and to refuse without giving reason(s). -England, Wales & Northern Ireland Energy Performance Certificates (EPC): To adhere to Part 5 of the Housing Act 2004, marketing may not commence on your property until we are in possession of a valid EPC.
-The Consumer Protection from Unfair Trading Regulations 2008: This act ensures that estate agents give potential purchasers accurate information about properties being marketed. You must provide Urban-X with information about your property that is true and accurate. Furthermore, you must notify Urban-X immediately of any changes to the information originally provided.
-Urban-X Agency also reserves the right not to publish any information provided by you.
-Estate Agency Act 1979: Under the terms of the above act Urban-X Estate Agency are obligated to disclose whether any person who has an interest in this property is an estate agent, a relative or associate of an estate agent. You must inform us if you are any of the previous categories so we can make the relevant disclosure.
-Payment Terms: When payment of commission is due, settlement must be within ten days of completion. In the event of any account remaining unpaid for more than twenty-eight days from the due settlement date, then Urban-X Agency reserves the right to charge interest on the balance at a rate of four percent above the National Westminster Bank Plc base rate at the time of completion. Further late charges will apply and upon non receipt. We reserve the right to escalate the proceedings to debt collectors or to court to recover the funds for services provided. The late fee structure will be laid out in writing within 60 days of non receipt of payment of the relevant date.
-In order to comply with the Money Laundering Act 2007, we will be undertaking a search verifying your identification using a third party's electronic database. Documents may include but are not limited to; passports, driving license, proof of income IE payslips / tax returns / P60s and proof of address confirmations such as bank statements / utility bills. Urban-X reserves the rights to decide what is deemed acceptable in each and every individual case in the interests transparency and compliance with the Money Laundering Act 2007.
-We reserve the right to recommend solicitors to complete the legal completion of your sale. We may earn a refferal fee for such a recommendation and reserve the right to not disclose the amount received. You may decline the recommendation and provide your own solicitors. In either case Urban-X will not cover any costs associated with legal proceedings, regardless of whether clients choose a recommended solicitors or their own.
-We reserve the right to request your forwarding address from any solictior for invoicing purposes of our services provided.
Property Valuation Disclaimer
Urban-X reserves the right to use 3rd Party valuation Tools in conjuction with Urban-X Agents property knowledge to estimate the value of your property’s market based on current market conditions.
Data Sources and Accuracy
Urban-X utilizes publicly available data sources, including maps and tables. However, data maybe incomplete or inaccurate and should not be relied upon exclusively.
Intended Use
Our estimations are intended for personal use and general interest to assist homeowners in assessing current property values and the UK property market trends.
Non-Reliance for Commercial Transactions
The way is which Urban-X reaches such property estimates is not suitable for commercial transactions or for formal contractual purposes.
Professional Valuation Recommendation
Before any property sale, purchase, mortgage, or related transaction, Urban-X strongly recommends that you obtain a professional valuation from a qualified surveyor or accredited professional.
Limitation of Liability
Urban-X Estate Agents, nor the 3rd party tools they use, do not accept liability for losses resulting from reliance on provided valuations. This includes but is not limited to loss of profit, loss of bargain, or indirect, special, or consequential losses. We do not guarantee uninterrupted access or error-free operation of our service. Our liability is limited to £100 unless otherwise required by law.
Statutory Rights and Consumer Protection
These terms do not affect your statutory rights. We do not attempt to exclude or limit our liability for matters that cannot be excluded or limited under applicable law.
Property Viewings disclaimer
-Ubran X will not be held responsible for any accidental damages that may be sustained at property viewings.
-Clients are to ensure their homes are clutter free and no trip hazards are present that may result in falls or injury to viewers of the property including members of the public or Urban X personnel.
-All pets must be kept away from mentioned parties with respect to potential allergies or agressive / unpredictable behaviour to promote a safe viewing experience.
-Urban X agents may recommend movement of furniture or various items to ensure high quality photograhps are taken to promote salability and / or to simply improve general salability. Any such movements are done with your consent and as such Urban X takes no responsibilty for accidents that may occur including but not limited to; ripped carpets, scuffed walls or floors, pulled blinds, broken items etc. This responsibilty and consent also applies to possible injuries to your person(s) including but not limited to; strained back, stubbed toes, bruising of the skin, ripped clothing, broken jewellery, falling over etc. Please take care & considerations into account before you agree to move items or furniture. If you have any concerns, especially if you are not medically fit, consider seeking assistance where possible or simply refuse the request or idea of the Urban X agent.
